📄 Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and DGZGames ("Company," "we," "us," "our") governing your use of the GovScope Android application and related services (collectively, the "Service").

These Terms apply to all users of the Service, including free and paid accounts. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

📱 The Service

GovScope is an Android application that aggregates publicly available U.S. federal government data — including contract opportunities from SAM.gov, grant opportunities from Grants.gov, and award records from USAspending.gov — and presents it in a searchable, filterable interface.

GovScope also provides a match engine that scores opportunities against a user-defined profile, an award intelligence view showing historical federal spending, and tools to save and monitor opportunities of interest.

GovScope is an independent informational tool. It is not a government service, is not affiliated with any federal agency, and does not submit applications or represent users in any procurement or grant process.

👤 Accounts

Registration. Some features require creating an account. You may register with an email address and password or via Google Sign-In. You agree to provide accurate and current information and to keep it up to date.

Security. You are responsible for maintaining the security of your account credentials. You are responsible for all activity under your account. Notify us immediately at support@dgzgames.com if you suspect unauthorized access.

One account per user. You may not create multiple accounts to circumvent free-tier limits or access controls.

Account deletion. You may delete your account at any time from within the app. Deletion is permanent and immediately removes your profile, saved data, and authentication record. See our Privacy Policy for details on data retention.

✅ Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service to violate any applicable federal, state, or local law or regulation.
• Attempt to circumvent access controls, rate limits, or subscription tiers through technical means.
• Use automated tools, bots, or scrapers to bulk-extract data from the Service.
• Interfere with the operation of the Service or its underlying infrastructure.
• Impersonate another person or organization, or misrepresent your affiliation.
• Use the Service to generate, distribute, or facilitate spam or unsolicited communications.
• Attempt to reverse engineer, decompile, or extract source code from the App.

We reserve the right to suspend or terminate access for any user who violates these terms or engages in abusive behavior toward the Service.

⭐ Subscriptions & Payments

Free tier. GovScope is available at no charge with limited functionality, including a cap on the number of search and match results displayed per session. Free features may change at any time without notice.

Professional license. A Professional license is available for purchase through the Google Play Store and grants unlimited access to all Pro features, including unlimited search results, keyword alerts with push notifications, agency track record intelligence, and full Award Intelligence. Current pricing is $19.99/month for the first 12 months, then $45/month thereafter. The applicable rate is confirmed at checkout in the Google Play Store. DGZGames reserves the right to change pricing for new subscribers with reasonable notice.

Billing. Subscriptions are billed monthly through Google Play. You agree to Google Play's billing terms in addition to these Terms. DGZGames does not store payment card information.

Renewals. Subscriptions renew monthly until cancelled. You may cancel at any time through the Google Play Store. Access continues until the end of the current billing period.

Refunds. Refund requests are subject to Google Play's refund policy. We may issue discretionary refunds in exceptional circumstances at our sole judgment.

No refund on account deletion. Closing your account removes your license without refund.

🏛️ Data Accuracy & Reliance

Government opportunity data in GovScope is sourced from SAM.gov, Grants.gov, and USAspending.gov through automated processes that sync nightly or via live API calls. Despite best efforts, data may lag, omit updates, or contain inaccuracies introduced during collection or processing.

You are solely responsible for verifying:

• The accuracy of any opportunity title, description, deadline, funding amount, or eligibility requirements.
• Whether an opportunity is currently open and accepting applications.
• Submission requirements and official point-of-contact information from the issuing agency.

DGZGames is not liable for any missed deadlines, disqualifications, or losses resulting from reliance on data displayed in the App.

🔄 Service Availability

We strive to maintain reliable access to the Service but do not guarantee uninterrupted availability. The Service may be unavailable due to maintenance, updates, outages from third-party providers (including Firebase, Google Cloud, or upstream government APIs), or events outside our control.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of material changes where practicable, but are not obligated to do so for minor changes or emergency maintenance.

🔗 Third-Party Services

The Service integrates with or links to third-party services including Google Firebase, Google Sign-In, Google Play, SAM.gov, Grants.gov, and USAspending.gov. These services are governed by their own terms and privacy policies. DGZGames is not responsible for the practices or content of third-party services.

Links to external sites, including official government opportunity pages, are provided for your convenience. We do not endorse or take responsibility for third-party content.

© Intellectual Property

All rights, title, and interest in the Service — including the App's code, design, branding, and user interface — remain with DGZGames. Nothing in these Terms transfers any intellectual property rights to you.

"GovScope" and associated logos are trademarks of DGZGames. You may not use our trademarks without prior written permission.

U.S. federal government data displayed in the App is in the public domain. DGZGames does not claim ownership of that data.

⚠️ Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. DGZGAMES EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

DGZGAMES DOES NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, OPERATE WITHOUT INTERRUPTION, OR BE ERROR-FREE. NO ADVICE OR INFORMATION OBTAINED FROM DGZGAMES OR THROUGH THE SERVICE CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

🛡️ Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DGZGAMES, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SERVICES — ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

DGZGAMES' AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO DGZGAMES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain liability exclusions or limitations, so the above may not fully apply to you.

⚖️ Indemnification

You agree to indemnify, defend, and hold harmless DGZGames and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit through the Service.

📝 Changes to Terms

We may update these Terms at any time. When we do, we will revise the "Last updated" date at the top of this page. For material changes, we will notify you through the App or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

If you do not agree to the revised Terms, you must stop using the Service.

🔚 Termination

You may stop using the Service at any time. You may delete your account within the App under Profile → Close account.

We may suspend or terminate your access to the Service immediately, without notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service ceases immediately.

Provisions of these Terms that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, and governing law.

🏛️ Governing Law & Disputes

These Terms are governed by and construed under the laws of the United States and the state in which DGZGames is incorporated, without regard to its conflict of law principles.

Informal resolution. Before filing any formal claim, you agree to contact us at legal@dgzgames.com and attempt to resolve the dispute informally. We will try to resolve the issue within 30 days.

Arbitration. If informal resolution fails, disputes shall be resolved through binding individual arbitration under the rules of the American Arbitration Association (AAA). You waive any right to participate in class action lawsuits or class-wide arbitrations. This arbitration clause does not apply to disputes involving our intellectual property rights.

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
