1. Parties
This EULA is a legal agreement between you ("End User") and DGZ ("Licensor"), the developer of MathRush ("App"). If you are entering into this EULA on behalf of a minor (e.g., a child using a parent's device), you represent that you are that minor's parent or legal guardian and agree to this EULA on their behalf.
2. Grant of License
Subject to your compliance with this EULA, DGZ grants you a limited, personal, non-exclusive, non-transferable, revocable license to:
- Download and install one copy of MathRush on a device you own or control
- Use MathRush solely for personal, non-commercial educational purposes
This license does not include the right to sublicense, distribute, or exploit the App commercially in any way.
3. License Restrictions
You may not:
- Modify, translate, adapt, or create derivative works based on the App
- Reverse engineer, decompile, or disassemble the App, except as expressly permitted by applicable law
- Remove or alter any proprietary notices, labels, or marks on the App
- Use the App in any way that violates applicable local, national, or international law
- Transfer, sell, resell, sublicense, or otherwise convey the App or your rights under this EULA to any third party
- Use automated tools to interact with, scrape, or extract data from the App
4. Intellectual Property
MathRush and all its components — including but not limited to the software code, graphics, sounds, user interface, game mechanics, and all associated intellectual property — are and remain the exclusive property of DGZ. This EULA does not grant you any ownership rights in the App. All rights not expressly granted herein are reserved by DGZ.
5. Advertisements
MathRush is free to use and is supported by advertising. App open ads are displayed through Google AdMob upon launching or resuming the App. These ads are non-personalized and configured under Google's child-directed treatment settings in compliance with the Children's Online Privacy Protection Act (COPPA). By using the App, you acknowledge that ads will be displayed and that certain data may be processed by Google AdMob. See our Privacy Policy for full details.
6. Privacy
Your use of MathRush is also governed by our Privacy Policy, which is incorporated into this EULA by reference. MathRush does not directly collect personal information. Gameplay data is stored locally on your device.
7. Updates and Modifications
DGZ may release updates, patches, or new versions of MathRush from time to time. You may be required to update the App to continue using it. DGZ reserves the right to modify, suspend, or discontinue any feature or the App itself at any time, with or without notice, and without liability to you.
8. Disclaimer of Warranties
MathRush is provided "as is" and "as available," without warranty of any kind. To the maximum extent permitted by law, DGZ expressly disclaims all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy of educational content, or non-infringement. DGZ does not warrant that the App will be available at all times, error-free, or free from bugs or other defects.
9. Limitation of Liability
In no event shall DGZ be liable for any indirect, incidental, special, exemplary, consequential, or punitive damages, including loss of data, loss of revenue, or loss of goodwill, arising out of or related to your use of or inability to use MathRush, even if DGZ has been advised of the possibility of such damages. DGZ's total cumulative liability to you under this EULA shall not exceed zero dollars (US $0.00), reflecting that the App is provided free of charge.
10. Termination
This EULA is effective until terminated. Your rights under this EULA terminate automatically and without notice from DGZ if you fail to comply with any term. Upon termination, you must cease all use of the App and delete all copies on your devices. Sections 4, 8, 9, and 11 survive termination of this EULA.
11. Governing Law and Dispute Resolution
This EULA is governed by the laws of the State of Texas, United States, without regard to its conflict of law principles. You agree that any dispute arising under this EULA shall be resolved exclusively in the state or federal courts located in Texas. If any provision of this EULA is found unenforceable, the remaining provisions remain in full force.
12. Entire Agreement
This EULA, together with the Privacy Policy and Terms of Use, constitutes the entire agreement between you and DGZ with respect to MathRush and supersedes any prior agreements or understandings.
