Terms of Service

                Please read these Terms of Service carefully before using PatchPulse. By accessing or using the application, you agree to be bound by these Terms. If you disagree with any part, you may not use the application.
            

1 Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and DGZ Games ("Company," "we," "us," or "our") regarding your use of the PatchPulse mobile application ("Application") available on Android devices via Google Play.

By installing or using PatchPulse, you confirm that you are at least 13 years of age (or the applicable age of digital consent in your jurisdiction), have the legal capacity to enter into these Terms, and agree to abide by them.

2 Description of Service

PatchPulse is an Android application that lets you build a watchlist of software vendors and products, then monitors public vulnerability and advisory sources on your behalf and alerts you when relevant information is published.

Core service capabilities include:

Vendor/product watchlist management
Automated monitoring of NVD, CISA KEV, EPSS, and vendor advisory sources
Push notifications when a new advisory matches your watchlist
Mute rules to suppress alerts you don't want
Pro-tier ticket tracking, notes, ownership, and due-date assignment for remediation workflows

                PatchPulse aggregates and surfaces publicly available advisory data. We do not perform vulnerability scanning of your systems, and inclusion or omission of any advisory does not constitute a guarantee of your security posture.
            

3 Free and Pro Tiers

PatchPulse is offered with a free tier (limited watchlist size and basic mute functionality) and an optional Pro subscription (expanded watchlist limits, ticket tracking, notes, ownership, due dates, and custom mute rules). Pro subscriptions are billed and managed through Google Play Billing and are subject to Google Play's terms, including auto-renewal and cancellation policies.

4 User Responsibilities

You are solely responsible for:

Configuring your watchlist accurately to reflect the software you actually use
Independently verifying any advisory before acting on it for critical remediation decisions
Maintaining the security of your device and any linked account credentials
Compliance with all applicable local, state, national, and international laws and regulations

5 Prohibited Uses

You agree not to use PatchPulse to:

Violate any applicable law, regulation, or third-party rights
Attempt to reverse-engineer, decompile, or extract source code from the Application
Scrape, republish, or resell the advisory data aggregated by the Application in bulk
Interfere with or disrupt the Application's servers, backend, or notification infrastructure
Circumvent or disable any security features or account limitations implemented in the Application

6 Google Play and Third-Party Platforms

PatchPulse is distributed through Google Play and relies on Google Firebase for backend services. Your use of these platforms is governed by Google's Terms of Service and Developer Program Policies. DGZ Games is not responsible for any actions, policies, or outages of Google LLC or any other third-party platform or data source referenced by the Application.

7 Intellectual Property

All content, features, trademarks, logos, and code included in or associated with PatchPulse ("PatchPulse Intellectual Property") are owned by or licensed to DGZ Games. Underlying advisory data (NVD, CISA KEV, EPSS, vendor advisories) remains the property of its respective publishers. You are granted no rights in any PatchPulse Intellectual Property except as expressly set forth in these Terms or the accompanying EULA.

8 Disclaimers

PatchPulse is provided on an "as is" and "as available" basis without warranties of any kind. DGZ Games does not warrant that:

The Application will be uninterrupted, error-free, or free of harmful components
Advisory data will be complete, timely, or free of errors introduced by upstream sources
Every relevant advisory for your watchlist will be captured or delivered
Push notifications will be delivered without delay in all network or device conditions

PatchPulse is an alerting and tracking aid; it is not a substitute for a formal vulnerability management or patch management program.

9 Limitation of Liability

To the fullest extent permitted by law, DGZ Games shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use PatchPulse, including but not limited to:

A missed, delayed, or inaccurate advisory notification
Any security incident, breach, or exploitation of a vulnerability not flagged by the Application
Loss of data stored in your watchlist or Pro tracking fields

10 Modifications to Service and Terms

DGZ Games reserves the right to modify, suspend, or discontinue PatchPulse at any time without notice. We also reserve the right to update these Terms at any time. Updated Terms will be posted at this URL with a revised effective date. Your continued use of the Application after any change constitutes your acceptance of the new Terms.

11 Governing Law and Disputes

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising in connection with these Terms or the Application shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration or the courts having jurisdiction over DGZ Games.
